1. AGREEMENT TO TERMS
By accessing or using the Plaintiff Funder website (the "Site"), you agree to be bound by these Terms of Use and all applicable laws. These terms constitute a legally binding agreement between you and Plaintiff Funder ("Company," "we," "us," or "our"). If you do not agree, you must cease use of the Site immediately.
2. DIRECT FUNDING SERVICES
Plaintiff Funder provides non-recourse pre-settlement funding directly to injured plaintiffs. We are a direct funder and not a broker or intermediary. Our services involve the purchase of a contingent interest in the potential future proceeds of your legal claim.
3. ELIGIBILITY AND USER REPRESENTATIONS
By submitting an application, you represent and warrant that:
- You are at least 18 years of age.
- You are currently represented by a licensed attorney.
- The information you provide is truthful, accurate, and complete.
- You are not seeking funding for a case that has already been fully resolved.
4. COMMUNICATION CONSENT (TCPA)
By providing your contact information, you expressly consent to receive communications from Plaintiff Funder via telephone, email, and SMS. This includes the use of automated technology to provide updates on your application status. You may opt out of marketing communications at any time.
5. INTELLECTUAL PROPERTY
All content on this Site, including text, logos, graphics, and code, is the property of Plaintiff Funder and protected by copyright and trademark laws. You may not reproduce or distribute any content without our express written permission.
6. NO LEGAL OR TAX ADVICE
Plaintiff Funder does not provide legal, financial, or tax advice. You are encouraged to consult with your attorney or a qualified professional regarding the implications of a pre-settlement advance.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Plaintiff Funder shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our services. We do not guarantee the approval of any funding application.
8. DISPUTE RESOLUTION AND GOVERNING LAW
Any dispute arising from these terms shall be resolved through binding arbitration. These terms are governed by the laws of the jurisdiction in which the Company is headquartered.
